After a clash with Admiral Adama, Major Apollo has resigned his commission in order to continue on Baltar’s defence council. Having revealed that she is taking drugs because her cancer has returned, President Roslin calls a press conference. Still feeling the loss of his wife, Starbuck, Anders finds comfort in Tory’s arms. After the scandal of his testimony in the trial, Tigh takes a leave of absence, his role as XO covered by Helo. Tigh continues to hear strange, haunting music throughout the ship; the tune is also experienced by Tyrol, Tory and Anders – but no one else seems to hear it… With the prosecution’s first two witnesses discredited, Baltar’s trial continues; Apollo advises his client to ask for a mistrial, but Baltar refuses, insisting that he wants the closure of a verdict. Visiting Doctor Cottle’s surgery for her cancer treatment, Roslin again experiences the vision of Hera; she is surprised to learn that both Athena and Caprica 6 also had the same dream – at exactly the same time… Taking the stand as the prosecution’s next witness, Lieutenant Gaeta commits perjury by lying; Lampkin responds by asking for a mistrial, on the grounds that one of the judges, Adama, has already decided on the outcome. Lampkin then stuns everyone by calling Apollo to the stand. In an impassioned speech Apollo shocks everyone present by opining that Baltar should be acquitted, as the evidence against him does not support the charges; he goes on to condemn the hypocrisy, shame and injustice of the proceedings, citing that while the mistakes of everyone in the fleet – those guilty of murder, cowardice, terrorism and mutiny – have all been forgiven, Baltar’s crimes have not. The defence then rests its case, and everyone awaits the outcome of the judges’ decision…
